The University of Leicester requires access to Oxford Law Trove, a digital platform providing comprehensive access to approximately 200 law textbooks published by Oxford University Press (OUP). This platform is integral to the University's law programs, offering authoritative and up-to-date legal resources.
Legal Basis for Sole Supplier Award:
Under the Procurement Act 2023, specifically Schedule 5, Paragraph 5, a contracting authority may directly award a contract to a single supplier when:
(a) The supplier holds intellectual property rights or other exclusive rights; and
(b) Only that supplier can supply the required goods, services, or works, with no reasonable alternatives available.
Application to the University of Leicester:
Oxford University Press holds exclusive rights to the content available on Oxford Law Trove. No other supplier can legally or technically provide access to these materials in the same format. Therefore, a competitive procurement process is not feasible without infringing upon OUP's intellectual property rights.
